I acted for Premier Marinas in their successful application to redevelop a marina and marine engineering works for a mixed use marina, marine engineering and residential scheme.
This application was determined after the new PPS25 was issued and the key challenge was to persuade the Environment Agency to interpret their guidance on the new Sequential Test and the Exception Test in a way which enabled them to withdraw their objection to the scheme after the application had been called in by the Secretary of State. The second highlight of this case was that we managed to persuade the Secretary of State to reverse the call-in decision. This is one of only two examples of a call-in reversal of which I am aware.
